Proving your right to work in the UK

The application deadline for the EU Settlement Scheme has now passed. Brought in after the UK left the EU, this scheme required EU citizens to apply for settlement or pre-settlement status in order to retain the right to continue living and working in the UK.

At Rapid Personnel, we made every effort to ensure that all staff impacted by these changes applied for either settlement or pre-settlement status. Settlement status if they had lived here continuously for at least five years before the end of 2020. Or pre-settlement status if they had been living here for less than five years. 

What do you do if you have missed the deadline? What are your rights?

You can still apply to the Home Office as the scheme will remain open ‘indefinitely’. However, you will need to prove that you had reasonable grounds for missing the 30th June deadline. We can help any candidates that have missed the deadline make a case to the Home Office, although we cannot guarantee the outcome. Even if you have successfully applied for settlement or pre-settlement status, if you are starting a new job after June 30th, you still must prove to your employer that you have the right to work in the UK.

What does this process look like?

The service you use is online and operates in real time. Before you start, you will need to make sure you have one of the following:

  • your biometric residence permit number
  • your biometric residence card number
  • your passport

Then go to: https://www.gov.uk/prove-right-to-work

You will be asked about your status under the EU settlement scheme. Then you will be asked to enter your biometric residence permit number. Once you have entered these details, the system will provide you with information about your right to work in the UK, which you can share with your employer or prospective employer.

This information will typically include the type of job you are allowed to do and how long you can work in the UK.
